Terminology
LCDZ: La Cucina Delle Zie, trading name of Le Zie sprl, also defined as the Shop
Site: the internet site http://www.lacucinadellezie.com
Webshop: the online shop accessible on the Site
User: any person accessing and using the Site, either by simply browsing its pages or by acting on it, e.g. downloading free material and/or placing an order on the Webshop. By extension, "use" will mean the actions carried out by the User on the Site
T&C: these Terms & Conditions, ruling the use of the Site and the sales concluded via the Webshop.

Art. 1 - Object and field of application
a) These T&C are implicitly accepted by the User by simle use of the Site.
b) By placing an order on the Webshop, the User is by this fact only deemed to be adult and responsible for his/her action, including the conclusion of a purchase.
c) These T&C shall be revised and updated periodically. The applicable version of T&C shall be the one published on the Site at the relevant moment of its use.

Art. 2 - Orders and purchases
The User agrees that by finalising the placement of an order has the same legale value as signing an order form, with any legal consequence thereof.
At any step of the ordering process, LCDZ shall inform the User about the confirmation of the order and its processing status. These communication shall be addressed solely to the email address provided by the User during the ordering process. The User is responsible of the correct and validity of the email address provided to LCDZ and shall update it in his/her account as needed.
LCDZ shall retain the right to refuse an order or to apply further conditions, especially as regards the cancellation of an order and the refund of the price. In such case, should the special conditions differ from these T&C, the special conditions shall apply for the differing aspects.
Art. 3 - Products and services
All products and services offered on the Webshop are described by LCDZ in the most complete and transparent way, according to the information available for LCDZ, especially when the products or services are manufactured by third parties. LCDZ does not bear any responsibility for any mistake incurred in the descriptions, in spite of the great care taken for compiling the descriptions themselves.
The stock is constantly updated and checked by LCDZ. Nevertheless, occasionally a product available in the Webshop might not be available in the physical stock, due to peremption, double sales or other reasons. In any such case, the User shall be offered the choice between a similar product, if available, or cancelling his/her purchase, with no further recurse for the User.
Any product or service offered on the Webshop comply with the relevant Belgian legislation. Any User purchasing the products and/or services from outside the territory of Belgium agrees acting in an informed way as to the compliance of the product and/or service in such foreign country.
LCDZ cannot be held responsible for any misuse of the products and/or services purchased on the Webshop, included any use non in compliance with the intended one. In the same way, any physical or material damage occurred as a consequence of a misuse of the product and/or service fall in the complete responsibility of the User.
Art. 4 - Prices
Any price displayed on the Site and/or on the Webshop are to be intended as including the relevant VAT applicable within Belgium for those products and/or services. All shipment costs are not included and are mentioned as a separate item before the purchase process is finalised.
According to the market evolution, prices can be amended as necessary, included in case of compliance with superseded laws or regulation. All prices are displayed with the express reserve for any material error occurred during the encoding process of the items. Any purchase concluded in such circumstances shall be automatically voided with no indemnisation for the User.

Art. 5 - Payment
All payments for products and/or services offered on the Webshop need to be performed via one of the proposed options, PayPal™ or Stripe™
a) PayPal™
PayPal™ is a secure payment platform available worldwide and offers several payment methods, including credit cards.
Transactions carried out on the Webshop are secured by PayPal™ payment system. All data provided in order to carry out the transaction are encrypted under SSL protocol. Such data cannot be retrieved, intercepted nor used by third parties. Such data are not stored on our IT system. This means that LCDZ does not have any knowledge of User bank data at any stage of the transaction.

b) Stripe™
Stripe™ is a secure payment platform available worldwide and offers several payment methods, including credit and debit cards.
Namely, Stripe™ is the default payment platform performing payments on the Webshop by bank card, Visa and Mastercard, although not exclusively.
Transactions carried out on the Webshop are secured by Stripe™ payment system. All data provided in order to carry out the transaction are encrypted under SSL protocol. Such data cannot be retrieved, intercepted nor used by third parties. Such data are not stored on our IT system. This means that LCDZ does not have any knowledge of User bank data at any stage of the transaction.

Art. 6 - Order collection
The User shall, by default, collect his/her purchase in our brick and mortar shop located in Rue Defacqz, 58, Ixelles (Brussels). The User shall receive an email confirming that the order is ready for collection.
If the User purchases any service (e.g. workshops, classes, seminars etc.), such service shall be performed in our brick and mortar shop at the above mentioned address. If the service has to be carried out in a different place, this will be duly noted in the description and recalled in the following correspondence with the User.
If a shipment is available and chosen by the User, this will be carried out via services of the postal service (BPost, in particular BPack 24h Pro) or private couriers. Said carriers shall be in cooperation with the postal service and/or private handlers in the country of final destination of the order. Pursuant to the applicable law, any shipment is made at risk of LCDZ.

Art. 7 - Cancellation of the order and right to withdraw
Upon collection of the order, the User shall check that it is correct in quality and quantity and shall verify the suitability to the intended use. If the User decides to refuse, in whole or in part, the products, he/she will return it to LCDZ. LCDZ shall therefore reimburse what is returned within 15 days, on the bank account communicated by the User at the moment of the return.
No service can be returned or cancelled after the enjoyment has started.

Art. 8 - Guarantee
The guarantee on products is limited to the guarantee for hidden flaws and to the consumer guarantee according to the law.
LCDZ is only liable for damages caused by malice or intentional act, LCDZ is not liable, in particular, for indirect damages, of any nature whatsoever, occasioned to the User or any third party to whom the User has given the products.
Art. 9 - Property rights
LCDZ remains the only owner of any product whose price has not been entirely paid.
Any elements of the Site included, but not limited to, logos, texts, pictures, photographs etc. are intellectual property of LCDZ. Any use, reproduction or exploitation of the Site or its contents is strictly forbidden without the prior written consent of LCDZ.

Art. 10 - Privacy
LCDZ complies with the applicable legislation on data protection and on consumer protection.
By using the Site and the Webshop, the User agrees on the treatment and use of his/her personal data in order to fulfil the orders, to issue invoices, perform the checks and administrative tasks thereof, and for marketing and advertising purposes. The treatment for marketing and advertising purposes shall only be carried out if the User has given his/her express consent during the purchase process. In no case LCDZ will be entitled to transfer such data to third parties. The User retains a right of control and access to his/her personal data and can, at any time, oppose any such treatment for marketing and advertising purposes. For further information, the User can access the public ledger kept at the Commission pour la Protection de la Vie Privée à Bruxelles.
Art. 11 - Applicable law
Any transaction stipulated with LCDZ on the Site or the Webshop and all obligations thereof shall be ruled by the laws of Belgium.
Any dispute arising because or about the transactions and activities carried out on the Site or the Webshop shall be deferred to the relevant jurisdiction applying the Belgian law.

Art. 12 - Responsibility of third parties
LCDZ does not bear any responsibility for the contents of any other website or webpage which might be linked to the Site or the Webshop, whether by hyperlinks or simple mention. Whereas LCDZ exercise its best endeavours to guarantee the correct functioning of the Site, it cannot be held responsible for damages caused by malfunctioning or non-functioning of the Site.
